Welcome to the Converse Australia website.  This website is provided as a service to our customers and is owned and operated by Conquest Sports (Aust.) Pty. Ltd.

The following rules and regulations apply to all visitors or users of the Converse Australia website.  By using this website, you agree to be bound by these rules and regulations.  We reserve the right to update or modify these Terms and Conditions at any time, without prior notice.  For this reason, we encourage you to review these Terms and Conditions whenever you use this website.  If you do not agree to these terms, please do not use the Converse Australia website.


Limitation of Liability

Conquest Sports (Aust.) Pty. Ltd shall not be liable for any damages suffered as a result of accessing, using, printing, copying or downloading the website. 

To the extent that Conquest Sports (Aust.) Pty. Ltd are able to limit the remedies available under the Terms, and subject to any other condition of the Terms, Conquest Sports (Aust.) Pty. Ltd expressly limit their liability for breach of a non-excludable condition or warranty implied by virtue of any legislation to the following remedies (the choice of which is to be at Conquest Sports (Aust.) Pty. Ltd's sole discretion):

(i)       in the case of services:

  1. the supply of the services again; or
  2. the payment of the cost of having the services supplied again.

In no event shall Conquest Sports (Aust.) Pty. Ltd be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with the services or the website or these Terms. The customer or user agrees to accept sole responsibility for the legality of the customer or user’s actions under the laws which apply to the customer or user and any transaction conducted directly or indirectly or in any way connected with the website or the goods or services. The customer and user agrees that Conquest Sports (Aust.) Pty. Ltd has no responsibility for the legality of any other customer or user’s actions or inactions.

Notwithstanding the above provisions, nothing in the Terms is intended to limit or exclude any liability on the part of Conquest Sports (Aust.) Pty. Ltd where and to the extent that applicable law prohibits such exclusion or limitation.

Conquest Sports (Aust.) Pty. Ltd further does not warrant the accuracy, suitability or completeness of the information, text, graphics, links or other items contained within the website.

You are solely responsible for adequate protection and backup of your data and/or equipment used in connection with the website and will not make and hereby waive any claim against Conquest Sports (Aust.) Pty. Ltd for lost data, re-run time, inaccurate output, work delays or lost profits resulting from the use of the website.

By using this website and agreeing to these Terms and Conditions, you agree to indemnify Conquest Sports (Aust.) Pty. Ltd and its employees and affiliates and hold Conquest Sports (Aust.) Pty. Ltd and its employees and affiliates, harmless against all loss, actions, proceedings, costs (including legal costs), expenses, claims, penalties, fines, expenses, costs and damages arising from or in relation to any breach by you of these Terms and Conditions, your access and/or use or exploitation of the website or reliance on its contents or information received through it by yourself or any person accessing any content through the website and as a result of any use or exploitation by you of any material posted by any third party or any other website, or both. This indemnification includes, without limitation, liability relating to copyright infringement, defamation, invasion of privacy and trademark infringement.

Conquest Sports (Aust.) Pty. Ltd does not warrant that your access to the goods and services or the website will be continuous or fault free and the customer and user acknowledges that Conquest Sports (Aust.) Pty. Ltd does rely on various service level agreements that it has with third parties from time to time and its ability to perform hereunder may be affected by the terms of such service level agreement.

The customer or user agrees to indemnify and continue to indemnify and hold Conquest Sports (Aust.) Pty. Ltd harmless from and against any claims, demands, proceedings, losses and damages of every kind and nature, known and unknown, including reasonable legal fees, made by any third party or customer or user due to or arising out of: (i) the customer or user’s breach of the Terms, or (ii) the customer or user’s violation of any law or the rights of a third party or (iii) as a result of any customer or user having a dispute with any other customer or user/s.

The customer or user shall comply with all applicable domestic and international laws, statutes, ordinances, common law and regulations regarding the customer or user’s use of the website and services. The customer or user agrees to ensure that any information posted by the customer or user on the website does not violate the Broadcasting Services Act 1992 (Cth), the Trade Practices Act 1974 (Cth) and any other applicable legislation. The customer or user is responsible for confirming that all activities are lawful and the customer or user must ensure that all applicable laws and the terms are complied with in every respect.


Intellectual Property Rights

Title, ownership rights and intellectual property rights in the content, whether provided by Conquest Sports (Aust.) Pty. Ltd, or by any other content provider, shall remain the sole property of us and/or the other content provider.  We will strongly protect its rights in all countries.

You may not copy, modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the content, in whole or in part, except  as is expressly permitted in this agreement.

These Terms and Conditions are governed by the laws in force in Victoria, Australia and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of Victoria, Australia and any courts which may hear appeals from those courts.

The provisions of the Terms are severable, and if any provision of the Terms is held to be invalid or unenforceable, such provision may be removed and the remaining provisions shall be enforced.

Conquest Sports (Aust.) Pty. Ltd's failure to act with respect to a breach by any customer or user or others does not waive its right to act with respect to subsequent or similar breaches.

Other than personally identifiable information, which is subject to Conquest Sports (Aust.) Pty. Ltd’s Privacy Policy, any material, information, ideas, suggestions, questions, comments or other communication which you post to this website in any manner will be considered non-confidential and non-proprietary.  Conquest Sports (Aust.) Pty. Ltd and our affiliates may use any or all such communications for any purpose, including, without limitation, reproduction, transmission, disclosure, publication, broadcast and/or marketing in any manner for any or all commercial or non-commercial purposes.  We may, but are not obligated to, monitor or review any communication by you.  We shall have no obligation to use, return, review or respond to any such communications.  We will have no liability related to the content of any such communications, whether or not arising under the laws of copyright, libel, privacy, obscenity or otherwise.  We retain the right to remove any or all communications that includes any material we deem inappropriate or unacceptable.

Ltd reserves the right to terminate or suspend your use of the website, without notice, for any reason or for no reason and without liability to you or any third party.  You are personally liable for any orders that you place or charges that you incur prior to termination.  We reserve the right to change, suspend or discontinue all or any aspect of this website, at any time, without notice.


Severability

If any of these terms is at any time held by any jurisdiction to be void, invalid or unenforceable, then it shall be treated as changed or reduced, only to the extent minimally necessary to bring it within the laws of that jurisdiction and to prevent it from being void and it shall be binding in that changed or reduced form.  Subject to that, each provision shall be interpreted as severable and shall not in any way affect any other of these terms.


International access

The Conquest Sports (Aust.) Pty. Ltd website may be accessed from countries other than Australia.  This website may contain products or references to products that are not available outside of Australia.  Any such references do not imply that such products will be made available outside Australia.  If you access and use this website outside Australia you are responsible for complying with your local laws and regulations.


Release and Indemnity

You agree to waive any and all claims that you now have or may have in the future against Conquest Sports (Aust.) Pty. Ltd and our associates, which relate to, or are incidental to any transaction.

You agree to indemnify and hold Conquest Sports (Aust.) Pty. Ltd harmless from and against any and all claims, loss or expense that may be incurred by Conquest Sports (Aust.) Pty. Ltd or our associates, which relate to or are incidental to the performance of its duties as described in these Terms and Conditions, including all legal costs incurred defending itself against a claim by any other person and/or as a result of you taking any action or refraining from taking any action or instituting or defending any action or legal proceeding.

You further agree to indemnify and hold Conquest Sports (Aust.) Pty. Ltd and our associates harmless from any claim made by any third party due to or arising out of your use of this website, the violation of these Terms and Conditions by you, or the infringement by you, or other users of this website using your account, or any intellectual property or other right of any person or entity.


Entire Agreement

The Terms are the entire understanding and agreement between the customer, user and Conquest Sports (Aust.) Pty. Ltd and those terms and conditions which are intended to remain after the termination or expiry of these Terms including but not limited to all indemnities owed to Conquest Sports (Aust.) Pty. Ltd by the customer and the user, shall survive any termination or expiration of these Terms.


Amendments to Terms and Conditions

Conquest Sports (Aust.) Pty. Ltd may terminate, suspend, change or discontinue any aspect of this website, including the availability of any features on this site, at any time and without notice. 

Conquest Sports (Aust.) Pty. Ltd reserves the right, at its sole discretion, to change, modify, add or remove any portion of these terms and conditions in whole or in part, at any time and without notice.  Conquest Sports (Aust.) Pty. Ltd may terminate the authorisation, rights and license given above at any time and without notice. Your continued use of this website after any changes to these terms are posted will be considered acceptance of those changes. In the event that a customer or user does not agree with the Terms, the customer or user must immediately cease their use of the website, not order any goods or services from Conquest Sports (Aust.) Pty. Ltd.

 

 


CONVERSE PRESENTS…A PAIR FOR A PAIR PROMOTION

Terms and Conditions  

 

1.             Information on how to enter and prizes form part of these Terms and Conditions.  Participation in this promotion is deemed acceptance of these Terms and Conditions.  Entries must comply with these Terms and Conditions to be valid.

2.             Entry is open to residents of Australia who are 15 years or over.  Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3.             To be eligible to enter individuals must purchase a pair of Converse shoes from any of the following participating retailers in NSW, VIC, ACT, SA, WA or QLD during the dates specified below:

 

-       Transit & Platypus (between 01/11/10 and close of business on 07/11/10)

-       Glue Store (between 08/11/10 and close of business on 14/11/10)

-       General Pants Co. (between 15/11/10 and close of business on 21/11/10)

-       Hype DC (between 22/11/10 and close of business on 28/11/10)

 

Entrants who make a qualifying purchase will be given a promotional card with a unique code printed on it.

 

4.             To enter, individuals must then visit www.converse.com.au/pairforapair follow the prompts to the competition entry page, enter the requested details including their full name, age, valid email address, full postal address, telephone number and the unique code found on their promotional card and submit the fully completed entry form by 11.59pm AEDST on 03/12/10. Individuals will be notified immediately on submission if they are an instant winner.  All valid entries (excluding instant prize winners) will also be entered into the Second Chance Draw.

 

5.             Entrants will be sent instant notification online advising that their submission has not been accepted if their online entry: (i) does not include a recognised unique code; or (ii) includes a previously submitted unique code.  Individuals with then be asked to check their submission against the unique code on the promotional card and resubmit their entry. Individuals may not send more than 5 unsuccessful web attempts each calendar day. On the 5th attempt to enter, that individual will be blocked from entering the promotion and will not be ‘unblocked’ until 9am AEDST the following day.

 

6.             Promotion commences on 01/11/10 and is open for purchases in the participating stores on the dates specified in clause 3 above. Online entries close at 11.59pm AEDST on 03/12/10.

 

7.             The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence). Verification is at the discretion of the Promoter. The Promoter also reserves the right to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

 

8.             Incomplete or indecipherable entries will be deemed invalid at the discretion of the Promoter.

 

9.             Multiple entries permitted, subject to the following: (a) only one entry permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with entry requirements; (c) only one unique code per entry is permitted; (d) the same unique code cannot be used more than once; and (e) unrecognised codes will be deemed invalid. 

 

10.           Entrants must retain their original purchase receipt(s) and promotional card(s) (with the unique code used to enter) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the promotional period but prior to entry.

 

11.           Each unique code cannot be used in any other promotion. The date and time a unique code is first received and validated will be registered to the email address given by the entrant at the time of entry. 

 

12.           If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

 

Instant Winners

 

13.           A certain number of promotional cards will be allocated to each State/Territory. Individuals will only be eligible to win tickets to the Big Day Out event in their State/Territory (excluding ACT entrants who will only be eligible to win tickets to the Big Day Out event in NSW). This will be determined by the address each entrant provides on entry.

 

14.           Instant Win Prizes available in each State/Territory are as follows:

-       NSW: 40 x pairs of tickets to Big Day Out in Sydney, NSW on 26/01/11;

-       VIC: 27 x pairs of tickets to Big Day Out in Melbourne, VIC on 30/01/11;

-       QLD: 9 x pairs of tickets to Big Day Out, Gold Coast, QLD on 23/01/11;

-       WA: 9 x pairs of tickets to Big Day Out, Perth, WA on 06/02/11;

-       SA: 4 x pairs of tickets to Big Day Out, Adelaide, SA on 04/02/11; and

-       ACT: 1 x pairs of tickets to Big Day Out in Sydney, NSW on 26/01/11.

 

15.           Instant winners will be notified immediately in writing online upon entry submission.

 

Second Chance Draw

 

16.           A random draw from all correctly registered and valid entries received during the promotion period (excluding instant prize winners) will take place at Peer Group, 153 Bridge Road, Glebe NSW 2037 on 08/12/10 at 12pm AEDST. Draw winners will be notified by email.

 

17.           Entries will be divided into the following six (6) State/Territory groups (depending on their State/Territory of residence): NSW, VIC, QLD, WA, SA and ACT.

-       The first 3 valid entries drawn from the NSW group will each win a pair of tickets to Big Day Out in Sydney, NSW on 26/01/11.

-       The first 3 valid entries drawn from the VIC group will each win a pair of tickets to Big Day Out in Melbourne, VIC on 30/01/11.

-       The first valid entry drawn from the QLD group will win a pair of tickets to Big Day Out, Gold Coast, QLD on 23/01/11.

-       The first valid entry draw from the WA group will win a pair of tickets to Big Day Out, Perth, WA on 06/02/11.

-       The first valid entry draw from the SA group will win a pair of tickets to Big Day Out, Adelaide, SA on 04/02/11.

-       The first valid entry drawn from the ACT group will win a pair of tickets to Big Day Out, Sydney, NSW on 26/01/11.

 

General

 

18.           Prize is for the winner and his/her companion. The winner’s companion must be 15 years or older in order to attend the Big Day Out event. All pairs of tickets to Big Day Out are valued at $310 each. All VIC and SA winners will be published in The Australian newspaper on 10/12/10.

 

19.           Big Day Out tickets may not, without the prior written consent of Ticketmaster, be resold or offered for resale at a premium (including via on-line auction sites) or used for advertising, promoting or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services, either by the original purchaser or any subsequent bearer. If a ticket is sold or used in breach of this condition, the ticket may be cancelled without a refund or other compensation and the bearer of the ticket may be refused admission.

 

20.           Scalping warning: In addition, the resale of tickets in certain circumstances is governed by ticket sales legislation and may attract criminal penalties. Tickets will be allocated to the name provided when provisional winner claims their prize. Only persons with photographic ID will be eligible to use the ticket.  Any name changes to winning tickets must be made in writing a minimum of 5 working days prior to The Big Day Out event in the winning tickets allocated state or territory.

 

21.           Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited.

 

22.           In the event that any prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value, subject to any written directions from the various lottery authorities.

 

23.           The Big Day Out event ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organizers hereby expressly reserve the right to eject any winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.

 

24.           The prize is subject to the terms and conditions of the organisers of the Big Day Out event.  The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner as a result of the conduct of the organisers of the Big Day Out event.

 

25.           Total prize pool value in each State/Territory is as follows: NSW - $13,330; VIC - $9,300; QLD - $3,100; WA - $3,100; SA - $1,550; ACT - $620. 

 

26.           Prizes are not transferable and are not redeemable for cash.  The Promoter’s decision is final and binding - no correspondence will be entered into.  The Promoter accepts no responsibility for late, lost or misdirected entries or other communications.  Entries will be deemed void if illegitimate, forged, manipulated or tampered with in any way.

 

27.           A random draw for any unclaimed prizes may take place on 12/01/11 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners (if any) will be notified by email and their names will be published in The Australian on 19/01/11.

 

28.           Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. The winners will be required to make themselves available for any publicity purposes specified by the Promoter without charge.  

 

29.           If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

 

30.           Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

 

31.           The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

 

32.           Printing and other quality control errors will not invalidate an otherwise valid prize claim.

 

33.           Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Any instant win prizes that are part of the advertised total prize pool will be awarded in the unclaimed prize draw.

 

34.           Instant win game materials are void if stolen, forged, mutilated or tampered with in any way.

 

35.           There will be a total of 5,000 instant win game cards printed for this promotion (2150 in NSW, 1500 in VIC, 500 in QLD, 500 in WA, 250 in SA and 100 in ACT).

 

36.           Before the prize is awarded, the winner (and any other person sharing the prize with the winner) will be required to sign an agreement to release the Promoter from and indemnify the Promoter against any liability arising from the use or participation in the prize.

 

37.           Prizes will be delivered to the Australian address specified by the winner.  

 

38.           Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if a Big Day Out event is cancelled/postponed for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) attendance at the Big Day Out event.

 

39.           The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants may access, correct, change and/or update their personal information and obtain a copy of the Promoter’s privacy policy by contacting the Promoter on (03) 8878 3000 during office hours. All entries become the property of the Promoter.

 

40.           The Promoter is not responsible for and makes no representation in respect to any tax implications that may arise from the prize winnings. Independent financial advice should be sought by the winners.
